By accessing or using BrandBreezy (the "Service"), you confirm that you are at least 13 years old, have read and understood these Terms, and agree to be bound by them. If you are using the Service on behalf of an organisation, you represent that you have authority to bind that organisation.

BrandBreezy is an AI-powered brand-building platform that helps you develop ideas, brand identities, positioning, marketing copy, and related assets. The Service may include free and paid features. Feature availability depends on your subscription plan.

• You are responsible for maintaining the security of your account credentials.
• You must provide accurate information when registering.
• You are responsible for all activity that occurs under your account.
• Notify us immediately if you suspect unauthorised access to your account.

You agree not to use the Service to:

• Violate any applicable law or regulation.
• Generate content that is unlawful, harmful, defamatory, obscene, or infringes third-party rights.
• Attempt to reverse-engineer, scrape, or extract training data from the AI models.
• Transmit viruses, malware, or other harmful code.
• Circumvent rate limits, usage quotas, or access controls.
• Use the Service to build a competing product without our written permission.

The Service uses AI models to generate content based on your inputs. You acknowledge that:

• AI outputs may be inaccurate, incomplete, or unsuitable for your purposes — always review before use.
• We do not guarantee that AI-generated brand names, slogans, or other content are free from third-party intellectual-property conflicts. You are responsible for conducting your own clearance searches.
• Subject to these Terms, you own the content you create using the Service.

All trademarks, logos, and service marks displayed in the Service are our property or the property of third parties. Nothing in these Terms grants you a licence to use them. The Service software, design, and documentation remain our exclusive property.

• Paid plans are billed on a recurring basis. You authorise us to charge your payment method on each renewal date.
• All fees are non-refundable except where required by law or stated otherwise at purchase.
• We reserve the right to change pricing with 30 days' notice. Continued use after the notice period constitutes acceptance of the new pricing.
• You may cancel your subscription at any time; cancellation takes effect at the end of the current billing period.

We reserve the right to suspend or terminate your account at our discretion if you violate these Terms or engage in conduct we deem harmful to other users or to us. You may delete your account at any time via Settings → Account.

The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or free of viruses.

To the fullest extent permitted by law, our total liability to you for any claim arising out of or relating to these Terms or the Service will not exceed the greater of (a) the amount you paid us in the 12 months preceding the claim or (b) $100 USD. We are not liable for indirect, incidental, special, or consequential damages.

These Terms are governed by the laws of the State of North Carolina, USA, without regard to its conflict-of-law provisions. Any disputes shall be resolved exclusively in the state or federal courts located in North Carolina.

We may update these Terms at any time. We will notify you of material changes by updating the effective date and, where appropriate, by email or in-app notice. Continued use of the Service after changes take effect constitutes your acceptance of the revised Terms.
